GIVENS, J. —

On the evening of July 24, 1931, Del Ray Huff and Lee Clark, formerly undercover men for the national prohibition department, Gerald Clark, brother of Lee Clark, and George McGee, were together at Newdale, and there is evidence they were drinking intoxicating liquor. Huff called appellant Fox at his residence in Idaho Falls without securing him, but the appellant McCarroll advised over the telephone that he would have Fox call, which he did from a pool-hall.
