Appellant was convicted of murder in the first degree for the killing of Mildred Van Vlack, nee Hook, who had previously secured an interlocutory decree of divorce from appellant in the state courts at Tacoma, Washington, but which had not ripened into a permanent decree (see the Washington Statutes hereafter cited) and which perhaps never could because of asserted acts of intercourse between appellant and deceased during the interlocutory period hereinafter more fully considered.
