The appellant and Charles Padillo and Augustine Mirando were jointly informed against for the murder of one H. C. McCarty, near Elk Grove, Sacramento County.
The appellant was tried separately and convicted of murder in the first degree, the jury awarding the death penalty. He moved for a new trial, which was denied, and from the order denying such motion and from the judgment he appeals. The theory of the prosecution on the trial of the cause was, that McCarty was killed in resisting an effort on the part of defendant, and his co-defendants, to rob him, and one Mize, of certain personal…
