TAYLOR, Justice.

Appellant (defendant below) was convicted of involuntary manslaughter, upon a charge arising out of an automobile colli sion which occurred on May 2, 1948, on Highway No. 44, five miles west of Boise, in Ada County, Idaho. A resumé of the facts follows. All of the points mentioned are in Boise except the place of collision.
