It is alleged in the bill of complaint that the plaintiff is a common carrier by railroad, operating within and between the States of Vermont, Massachusetts and Connecticut; that the defendant is the commissioner of motor vehicles of the State of Vermont, and, as such, the enforcing officer of the gasoline tax statute, chapter 52 of title 8 of the Public Laws; that certain trains operated by the plaintiff in interstate commerce use gasoline for fuel; that the gasoline for such trains is purchased by the plaintiff at places outside the State of Vermont, and imported to five storage places…
