DECISION AND ORDER
LARIMER, Chief Judge.
I. INTRODUCTION
The facts of this case are set forth in my prior decision,1 entered December 12, 2000 (Dkt.# 139), familiarity with which is assumed, and will not be repeated at length here. Briefly, Richard Seils (“Seils”) and Lois Vreeland (“Vreeland”) (collectively “plaintiffs”), teachers in defendant Rochester City School District (“RCSD”) and members of former defendant Rochester Teachers’ Association (“RTA”), commenced this action against twenty-eight defendants.
