INTRODUCTION

Non-party Electronic Payment Exchange (“EPX”) has moved to intervene in this action by right and by permission under Fed. R.Civ.P. 24(a) and (b). Item 61. EPX seeks to intervene as a plaintiff to obtain judgment against the First Capital defendants1 in the amount of $660,121.39, together with interest, costs, and other fees, and to obtain an order from this court directing the Permanent Receiver, Garry M.
