Before RABINOWITZ, C. J., and CON-NOR, BURKE, MATTHEWS and COMPTON, JJ. RABINO WITZ, Chief Justice.

This dispute is between one defendant (the Municipality of Anchorage, hereafter the Municipality) and one former defendant (Stephan & Sons, Inc., hereafter S&S) in a separate damages action brought by the mother of Walter DeHusson. The issue is whether S&S, a construction contractor, had a duty to defend the Municipality in the DeHusson action.
