This case is before the court on defendant’s motion to dismiss pursuant to RCFC 12(b)(1), and the parties’ cross motions for summary judgment pursuant to RCFC 56. The primary issue in this case is whether the court has jurisdiction to entertain plaintiffs claims based upon the Federal Employees’ Compensation Act (the “FECA” or the “Act”), 5 U.S.C. §§ 8101-8193 (1994). For the reasons set forth below, the court grants defendant’s motion to dismiss. Accordingly, plaintiffs motion for summary judgment and defendant’s cross motion for summary judgment are moot.…
