Currently before the Court is Defendant’s motion to dismiss Plaintiffs complaint for lack of subject matter jurisdiction and for failure to state a claim upon which relief can be granted. Plaintiff asserts that this Court has jurisdiction pursuant to the Tucker Act, and that his claim arises under the Federal Employees’ Compensation Act (“FECA”) (5 U.S.C. § 8101 et seq.) and the due process clause of the Fifth Amendment.
