OPINION

ANDERSON, Judge.

Southwestern Petroleum Corporation ("SWEPCO”) and Roy D. Tate (“Tate”), Defendants, appeal a $17,000 Circuit Court non-jury judgment in Roane County in favor of the plaintiff school district in a breach of contract action arising out of the failure of a school roof repair in Harriman, Tennessee.

FACTS

The Bowers Elementary School in Harri-man was built in 1960. Its roof is essentially flat, sloping slightly to the middle of the building in a “V” configuration with drain openings located at the base of the “V” to carry away runoff water. The roof covering originally was…
