OPINION

HENRY, Justice.

This contract action involves the development and construction of federally subsi dized low-rent housing in Johnson City. The parties seek damages for alleged breaches of their respective contractual obligations. The trial court awarded the V. L. Nicholson Company (contractor) a judgment against Transcon Investment and Financial, Ltd., (developer) and dismissed Nicholson’s complaint against Johnson City Leased Housing Corporation (owner), characterizing the latter as a “creature and vehicle of Transcon.” Nicholson appeals from a judgment rendered by the Court of Appeals…
