This was a suit to rescind a contract pertaining to the lease and sale of real property upon the ground that defendant had failed to perforin conditions thereof, and particularly those set out in paragraph 8 of the contract. (A copy of the contract is attached hereto as Appendix “A.”) Defendant answered that paragraph 8 of the contract was void, and by cross bill sought a. reformation of the contract to eliminate that paragraph.
