Plaintiffs sued for a share of the profits in a real-estate transaction, and recovered judgment, from which defendant appeals.

The plaintiffs are partners engaged in the real-estate business at Emporia. The defendant is a corporation organized under the laws of Nebraska and engaged in the business of buying and selling real estate. The petition alleges that on the 28th day of November, 1910, the defendant company purchased, for the purpose of resale at a profit, certain real estate in Lyon county, consisting of 1167 acres, and known as the…
