The plaintiff, a police officer of the city of Hartford, in the performance of his duty on April 6, 1940, at about 12:45 a.m., was crossing Park Street from the north to the south side to quell a disturbance, when he was struck by an automobile operated by the defendant and was injured. The case was tried to the court and judgment rendered in favor of the plaintiff, from which the defendant has appealed, asking that the finding of the trial court be corrected in certain particulars and claiming that as so corrected contributory negligence is established as a matter of law.
