Defendant, a physician of the city of Shreveport, had a patient he desired to take to a sanitarium in Dallas, Tex., and plaintiff, a deputy sheriff of Caddo parish, was employed to accompany him on the trip. They left Shreveport in defendant’s Buick sedan automobile about 4 o’clock the evening of July 19, 1930. They reached Dallas between 1 o’clock and 2:30 o’clock the following morning. Thirty minutes were spent at the sanitarium and then they began the return trip to Shreveport. Defendant did the driving over and back to the time and place of accident hereinafter described.
