Reversing.

The appellant, Jonah Richardson, was separately-tried in the court below under a joint indictment charging bim, Harlow Richardson, Bertie Richardson and Arch Harris, with the crime of breaking into the depot of a common carrier, with intent to steal therefrom. The trial resulted in his conviction, the verdict of the jury-fixing his punishment at confinement in the penitentiary not less than two years nor more than two years and a day.
