This is the second appeal from a judgment of conviction under an indictment charging the appellant with the murder of Martha McQuin Martin. The facts of the case so fully appear in the opinion delivered on the former appeal that we deem it unnecessary to again state them. Bess v. Commonwealth, 116 Ky., 927, 77 S. W., 349, 25 Ky.
