The plaintiff, Mat Lakes, was arrested under a warrant which accused him of the offense of unlawfully having in his possession spirituous liquors, other than for sacramental, medicinal, scientific or mechanical pur*242poses, in Madison county. The warrant was issued by the defendant, as judge of the Madison quarterly court, before whom the plaintiff was carried by the arresting officer.
