Reversing.

By this appeal appellant, Harris B. Kirby, would bave us reverse tbe judgment of tbe Clark circuit court adjudging that be serve a term of 18 months in tbe penitentiary for grand larceny. Appellant was convicted of having stolen a Ford touring car belonging to tbe Road Department of tbe State of Kentucky. Tbe car bad been left parked on Main street, in Winchester, Kentucky, and was stolen between seven and nine o ’clock on tbe evening of March 11,1924.
