This is an action for declaratory judgment brought in connection with an automobile liability insurance policy. The plaintiff, Metropolitan Property and Casualty Insurance Company (“Metropolitan”) seeks a declaration that it is under no duty to defend or indemnify the defendant, Claudette Espach, in a state superior court action filed against her as the administra-trix of the estate of her deceased son, Michael Espach.
