This case Avas argued and submitted Avith the case of Murphy, Adm'r, v. Willow Springs Brewing Co., p. 223, post. The petition sets forth the same facts as the petition in the latter case Avith the exception of the appointment of the administrator; the injury Avhich resulted in the death of James A. Murphy being stated in substantially the same language in each case. To this petition a general demurrer ay:is interposed, Avliich Avas -sustained by the court; and, from the judgment dismissing the action, the plaintiffs appeal.
