On the evening of the 28th day of June, 1907, Jones Pilldns, in attempting to cross the tracks of the Chicago & Northwestern Raihvay Company at Battle Creek, was run over by the engine and cars and instantly killed. This plaintiff, who is his widow, began this action in her own behalf and in behalf of her four minor children in the district court for Madison county to recover damages alleged to have been suffered because of his death.
