DELEHANT, District Judge.
The plaintiffs above identified, all citizens of states other than Nebraska, filed the complaint in this case on April 18, 1949, and prayed for judgment largely in excess of $3,000, exclusive of interest and costs, as damages, (a) in one count, for the death, and (b) in another count for pain and suffering sustained prior to the death, on March 21, 1949, of Elmer E. Fouraker, as the results of injuries by him suffered in consequence of the alleged negligence of the defendant in the maintenance and condition of repair of a bridge or culvert, located in Richardson…
