MEMORANDUM ORDER & OPINION
JACKSON, District Judge.
This matter is before the Court on Plaintiffs Motion for Summary Judgment filed on September 29, 1999. 1 No response to the Motion was received from the Claimant and the time for such a filing has elapsed. 2 Accordingly, the matter is ripe for judicial review. For the reasons discussed infra, the Plaintiffs Motion for Summary Judgment is GRANTED.
