CANBY, Circuit Judge.

The Government of the Commonwealth of the Northern Mariana Islands (CNMI) and Charles Reyes, the Acting Chief of its Immigration and Naturalization Office appeal the district court’s summary judgment holding them liable to plaintiff Yolanda U. *482DeNieva and a subsequent jury award of $50,000. We affirm the judgment against Reyes in his individual capacity, and reverse the judgment insofar as it runs against the CNMI.
