OPINION ON APPELLANT'S PETITION FOR DISCRETIONARY REVIEW

OVERSTREET, Judge.

Gerry La-Keith Brown, appellant, was charged by indictment with murder, alleged to have been committed on November 29, 1988. Appellant was found guilty by a jury on May 8, 1989 in the 203rd Judicial District Court of Dallas County and sentenced to confinement for life in the Texas Department of Criminal Justice, Institutional Division. In an unpublished opinion, the Fifth Court of Appeals reversed the trial court’s judgment. This Court vacated that decision and remanded the case for consideration of the implied consent…
