Appellant has here appealed from the decision of the Board of Interference Examiners of the United States Patent Office awarding to appellee pr'-'-ity of invention of certain subject matter pertaining to an apparatus for coating frozen confections and defined by the five counts in issue. The interference involves the application of appellee Otken filed November 10, 1948, and the patent to appellant Herrmann issued October 5, 1948, on an application filed June 4, 1948.
