WILLARD, District Judge.
The plaintiff brought this action in the district court of Ramsey county, in the state of Minnesota, to recover the .sum of $35,500 for personal injuries suffered by him by reason, as he alleged, of the negligence of the defendant. The complaint stated that both the plaintiff and the defendant were citizens of the state of Wisconsin, and alleged facts which would seem to bring the case within the provisions of the act of Congress of April 22, 1908, c. 149, 35 Stat. 65 (U. S. Comp. St. Supp. 1909, p. 1171) — the employer’s liability act. The questions now to be decided…
