SOPER, Circuit Judge.
This suit against the Duke Power Company under § 301 of the Labor Management Relations Act, 29 U.S.C.A. § 185, was instituted by the Brotherhood of Railroad Trainmen, an unincorporated association, and certain individuals formerly employed by Duke in the operation of a motor bus transportation system at High Point, North Carolina. It was alleged in the complaint that Duke had broken a collective bargaining contract which it entered into with the Brotherhood in 1953 when it retired from the bus business in High Point and sold its buses and other equipment to one H.
