In the argument of the case here, the first exception taken by the plaintiff’s counsel to the Judge's charge is, that it oughtto have been submitted to the jury to decide, whether or not the first contract was rescinded by the parties. His Honor instructed the jury there was no evidence, that the original contract had been rescinded and another substituted. There can be no doubt, but that the construction of a contract is a matter of law.
