This is an appeal from a judgment .of the district court of Woods county rendered on the 26th day of October, 1927. The petition in error with transcript was received by the clerk of this court on the 25th day of April, 1928, accompanied by the sum of $5 as a cost deposit in said cause. On the same day the clerk of this court returned the '$5 to the attorneys for the plaintiffs in error by mail and informed them that the cost deposit required under the law of this state was $25.
