A jury awarded Rhonda Otting compensatory and punitive damages on her discrimination claim against J.C. Penney pursuant to the Americans with Disabilities Act (ADA), 42 U.S.C. § 12112 (1994). Following the jury’s verdict, J.C. Penney moved for judgment as a matter of law (JAML), or in the alternative, for a new trial, pursuant to Rules 50 and 59 of the Federal Rules of Civil Procedure.
