Plaintiff sued defendant for a real estate commission. The trial court sustained a demurrer to his evidence, and he appeals. The sole question is whether or not the evidence, as against a demurrer, was sufficient to sustain a cause of action. Upon a demurrer to the evidence the court cannot weigh conflicting evidence, but must consider all evidence as withdrawn which is most favorable to demurrant and determine whether or not liability is proven upon all the facts which the evidence favorable to demurrer in the slightest degree tends to prove and all inferences or…
