The defendant in error, who will be hereafter denominated “plaintiff,” on the 8th day of September, 1904, began her action in the district court of Comanche county against plaintiff in error, who will hereafter be denominated “defendant,” to recover damages in the sum of $10,000 for and on account of injuries received by her in a wreck while she was traveling on one of the trains of defendant.
