This case presents error from the district court cf Wagoner county. July 23, 1906, Andrew C. Davis filed his complaint in equity against the defendant, the Creek Land & Improvement 'Company, in the office of the TTnited States Court for the Western District of the Indian Territory, sitting at Wagoner. The purpose of the action'was to have a certain deed of conveyance from Maria and James Jefferson to J. S; Brucker, of the date of July 30, 1904, declared a mortgage and given for’ security for the payment of the sum of $235, and to have the said deed and certain other deeds made by said J. S.…
