Plaintiff Albert Chinchillo brings this action under the Rehabilitation Act of 1973, 29 U.S.C. § 701 et seq. He alleges that the Federal Deposit Insurance Corporation discriminated against him when it terminated him for poor performance caused by his disability — severe depression. Defendant has moved for summary judgment on the ground that plaintiff has failed to make out a prima facie case under the Rehabilitation Act.
