This is an appeal from the district court’s dismissal of the plaintiffs complaint under the Age Discrimination in Employment Act (ADEA), Pub.L. 90-202, 81 Stat. 602 (1967), as amended, Pub.L. 95-256, 92 Stat. 189 (1978), 29 U.S.C. § 621 et seq. (1982). The district court’s granting of the defendant’s motion to dismiss was based upon its conclusion that the plaintiff’s filing of a charge of unlawful age discrimination with the Equal Employment Opportunity Commission (EEOC) was untimely under 29 U.S.C. § 626(d)(2).
