This matter arises from a report, pursuant to G. L. c. 231, § 111 (1990 ed.), and Mass. R. Civ. P. 64, 365 Mass. 831 (1974), by a judge of the Superior Court. The plaintiff, Hull Municipal Lighting Plant (HMLP), filed a motion in the Superior Court in Plymouth County seeking enforcement of subpoenas duces tecum issued by an arbitrator. Massachusetts Municipal Wholesale Electric Company (MMWEC) moved to quash the subpoenas claiming common law privileges and statutory exemptions from the public records statute.
