Erom Oass Circuit Court; John 8. Lairy, Judge. Suit by Eobert Cromer and another against the City of Logansport. Erom a decree for plaintiffs for less than their' claim, they appeal.

The appellants, as owners of certain real estate in the city of Logansport, sued the appellee to recover damages for injury caused by water which the city by its grading and construction of streets brought to said real estate, for which it failed to provide an outlet, whereby it overflowed the real estate of the appellants, and also to obtain an injunction to prevent the continued recurrence *664of such injury, the complaint being filed September 5, 1903.
