This action was brought by the appellee to recover damages alleged to have been sustained by him, through *324the negligent and wrongful acts of the appellant, in so constructing the sewers in said city as to cast water upon the premises of the appellee. A demurrer to the complaint was overruled, and an answer of general denial was filed. The cause was submitted to a jury for trial, and a verdict returned in favor of appellee.
