Shortly after 6 o’clock on the evening of September 17, 1931, the defendant Cagle, driving a loaded truck and trailer belonging to the defendant Zimmer, was proceeding south on a paved highway near the city of Brawley. "While passing what is known as Carter’s Service Station at a speed of some fifteen or twenty miles an hour, the engine on the truck commenced to sputter or slow down.
