Plaintiff sued and defendants counterclaimed for fraud and breach of contract. Plaintiff is a metal broker. As for defendants, Ace Iron & Metal Company and Atomic Iron & Metal Company are corporations maintaining scrap yards to buy, process, and sell new and scrap metals; Aetna Smelting & Refining Company is a Ben and Mas Gladstone partnership; and Ben and Mas Gladstone are officers of Ace and Atomic.

Most of the facts with regard to three transactions between plaintiff and defendants were strongly disputed by defendants during a lengthy trial, judge Gilmore, jury having been waived,…
