MUNGER, District Judge.

The plaintiff in error brought an action in replevin against defendants in error, Nichols, Miller, and Briscoe, to recover possession of some cattle. At the close of plaintiff’s evidence the court directed a verdict in favor of the defendants. The plaintiff claimed the right of possession because of a lien arising from a chattel mortgage given to it by defendant Nichols. The defendants Miller and Briscoe, as partners, from whose possession the property was taken under the writ, claimed the right of possession because they had purchased the cattle of Nichols, without…
