This contract case is before the court following oral argument on Defendant’s Motion to Dismiss or, in the Alternative, Motion for Summary Judgment (Def.’s Mot.).1 Plaintiff CW Government Travel, Inc. (Carlson) filed its complaint in this action on April 26, 2004, seeking a declaratory judgment that it is the exclusive provider of “ ‘traditional’ travel services” to fifty-four Military Entrance Processing Stations (MEPS) under four competitively-awarded, long-term travel management contracts (Contract(s)) with the Department of the Army (defendant).
