SICKEL, Circuit Judge.

The plaintiffs are taxpayers and electors of the State of South Dakota. The defendant is the State Treasurer. The action was brought by plaintiffs as an original proceeding in this Court to prevent the defendant as State Treasurer from performing the duties imposed on him by Chapter 277, S. L. 1943, commonly referred to as the tithing law. This statute provides that ten per cent of the gross receipts of eighteen state boards and commissions shall be transferred to the general fund of the state.
