The Fidelity & Deposit Company of Maryland brought this suit against the National Bank of Commerce of Dallas, J. B. Adoue and W. Illingworth. The bank is sought to be made liable upon the following instrument in writing, which is made the basis of the suit:

“The National Bank of Commerce,
“Dallas, Texas, June 10, 1901.
“$10,159.00.
“The National Bank of Commerce, of Dallas, Texas.
