G. R. Morgan brought this suit against the City National Bank in Wellington, Tex. He alleged that the bank, in consideration of his doing his banking business with it, agreed to make loans for him of any money which he might from time to time desire to put out at interest and to guarantee the payment of such loans; that acting under the contract the bank made a loan of $3,000 of plaintiff's money to one J.
