This suit was instituted by the appellant the Citizens’ National Bank of Cameron, Tex., hereinafter called the Cameron Bank, against the Good Roads Gravel Company, a corporation, C. B. Scronce, J. L. Baughman, and J. W. Hertford and others, by filing its original petition. No copy of this original petition is in the transcript so as to enable us to determine the date of its filing, or who were then sued as defendants; nor is there anything in the entire record by which such information can be ascertained, except a recital in the findings of fact by the trial judge that said original petition…
