J. E. Price, the appellant, was plaintiff in the court below, and the appellee, R. L. Gosnell, was defendant. The plaintiff filed his amended petition in the district court of Comanche county to which a demurrer was interposed by the defendant. From a -judgment sustaining the demurrer and dismissing the action, plaintiff appeals. The election of plaintiff to stand upon his amended petition presents but one question in this court for consideration, viz: Does the amended petition state facts sufficient to Constitute a cause of action?
